BC SUPREME COURT JUDGE IGNORES THE LAW

Judges who ignore the law do not belong on the bench.

On January 30, 2019 at the Scott Road Sky Train Station, Daon Gordon Glasgow shot point blank at Vancouver Metro Transit Police Constable Josh Harms.

Const. Harms was hit twice, once in the arm, and once in the hand when he approached Glasgow who was sitting on a Skytrain station bench.

Crown charged Glasgow with attempted murder. At trial BC Provincial Court Judge Peder Gulbransen convicted Glasgow of the lesser charge of aggravated assault. Crown got the charge right, but Judge Gulbransen got it wrong, and showed leniency!

According to s. 231 of the Criminal Code it states that:

(4) Irrespective of whether a murder is planned and deliberate on the part of any person, murder is first degree murder when the victim is

(a) a police officer, police constable, constable, sheriff, deputy sheriff, sheriff’s officer or other person employed for the preservation and maintenance of the public peace, acting in the course of his duties;

Glasgow has an extensive criminal record which includes a conviction for manslaughter and was residing in an halfway house at the time he shot Const. Harms. Glasgow’s previous criminal record was before the courts at trial, so why did Judge Gulbransen ignore the law and show leniency?

At trial Glasgow was also convicted of discharging a restricted firearm with the intent of endangering the life of Const. Harms. Further, Glasgow was also convicted of intentionally discharging a firearm while being reckless as to the life or safety of others, and of possessing a loaded restricted firearm.

Prior to getting appointed to the BC Provincial Court Judge Peder Gulbransen was a Provincial Crown Prosecutor, and an extremely biased one at that!

Even as a judge Gulbransen is extremely biased! The criminal justice system is broken because judges (both Provincial and BC Supreme) ignore the law and make their bias be known.

In 2000 when Gulbransen was a Crown Prosecutor he refused to lay charges against a female stalker where the victim was a male. And in 2009, as a judge, Gulbransen once again showed his biasness when he dismissed a Private Prosecution. And again, the accused was a female stalker, and the male, a victim.

So, its not surprising that Judge Gulbransen, once again ignored the law and showed leniency against a violent convicted criminal.

There is only one way to fix the Canadian Criminal Justice System, and that is to adapt the US system of voting judges at the Provincial and BC Supreme levels of Court. That way, if a lower Court Judge at both Provincial and BC Supreme, including Registrars and Masters can be impeached for ignoring the law!

Once again Justice Denied is Justice Delayed!
